Website Ownership; Acceptance of Terms

These Terms of Use govern your access to and use of www.alartis.jp and the pages and services made available through it (collectively, the "Site"). The Site is owned and operated by Alartis株式会社 ("Alartis"), a company established in Japan and operating the Site from Chiba, Japan.

By accessing or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.

Alartis may update these Terms of Use from time to time. Any revised terms become effective when posted on the Site unless otherwise stated. Your continued use of the Site after an update constitutes acceptance of the revised terms.

Content and Intellectual Property

Unless otherwise indicated, the text, graphics, photographs, artwork images, logos, visual elements, page design, software and other materials made available on the Site (collectively, "Content") are owned by, licensed to, or used with permission by Alartis and are protected by applicable copyright, trademark and other intellectual-property laws.

You may view the Content and use the Site for personal and lawful purposes. Except where expressly permitted by Alartis or by applicable law, you may not reproduce, republish, distribute, modify, publicly display, commercially exploit or systematically extract Content from the Site without prior written permission.

Any rights relating to artworks, photographs or other materials belonging to third parties remain with their respective rights holders.

Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of Alartis or any third party.

You must not attempt to gain unauthorized access to the Site, user accounts, servers or connected systems; interfere with the operation or security of the Site; introduce malicious code; impersonate another person or entity; use false or misleading information; or use automated tools in a manner that places an unreasonable load on the Site or circumvents technical access controls.

Alartis may restrict or block access where reasonably necessary to protect the Site, its users, its systems or its legal rights.

Products, Orders and Payments

Products displayed on the Site are subject to availability. Descriptions, images, dimensions, condition information and other product details are provided in good faith and may be updated when necessary. For certain items, including original artworks, the price may be provided upon request.

Submitting an inquiry or order does not by itself guarantee acceptance of an order. A transaction becomes binding only when Alartis confirms the order or otherwise accepts it in accordance with the applicable sales process.

Additional terms, including the applicable Sales and Refund Policy, shipping terms or product-specific conditions, may apply to a purchase and form part of the agreement for that transaction.

Payments, where available, may be processed by independent third-party payment service providers. The availability of any payment method may depend on the provider's terms, eligibility requirements, geographic availability and applicable law.

Alartis may refuse or cancel an order where reasonably necessary because of product availability, pricing or listing error, suspected fraud, legal or regulatory requirements, sanctions or export-control restrictions, payment-processing requirements, or other legitimate compliance or security reasons. Any refund due in such circumstances will be handled in accordance with the applicable payment method and sales policy.

Nothing in these Terms limits any mandatory rights available to consumers under applicable law.

Accounts and Security

Certain Site features may require a user account. You are responsible for providing accurate information, maintaining the confidentiality of your credentials and promptly notifying Alartis if you become aware of unauthorized access or other security concerns.

You may not use another person's account without authorization or create an account using false or misleading identity information.

Privacy

Alartis's Privacy Policy applies to the collection and use of personal information through the Site and forms part of these Terms of Use. Please review the Privacy Policy available on the Site.

Internet communications cannot be guaranteed to be completely secure. Please use appropriate care when transmitting information online.

Third-Party Sites and Platforms

The Site may contain links to independent third-party websites, marketplaces, social-media platforms, payment providers or other services. Such links are provided for convenience or to enable related services.

Alartis does not control independent third-party services and is not responsible for their content, availability, security or separate terms and policies. Your use of a third-party service is subject to the terms applicable to that service.

Disclaimer

The Site and its Content are provided on an "as is" and "as available" basis. Alartis makes reasonable efforts to keep information accurate and the Site available, but does not guarantee that the Site will always be uninterrupted, error-free or free from harmful components.

To the fullest extent permitted by applicable law, Alartis disclaims warranties that are not expressly stated in these Terms or in a separate agreement applicable to a particular product or transaction.

Nothing in these Terms excludes or limits any warranty, liability or consumer right that cannot lawfully be excluded or limited.

Limitation of Liability

To the extent permitted by applicable law, Alartis will not be liable for indirect, incidental, special or consequential losses arising solely from use of, or inability to use, the Site.

This limitation does not apply where liability cannot be excluded or limited under applicable law, including where otherwise required by Japanese consumer-protection law.

Indemnity

To the extent permitted by applicable law, you agree to be responsible for losses or claims reasonably incurred by Alartis as a direct result of your unlawful use of the Site, infringement of third-party rights, or material breach of these Terms.

Suspension or Termination of Access

Alartis may suspend or terminate access to all or part of the Site where reasonably necessary because of a material breach of these Terms, suspected fraud or abuse, security concerns, legal or regulatory requirements, requests from competent authorities, technical issues, maintenance, or discontinuation of a Site feature.

Where appropriate and legally permissible, Alartis will take reasonable steps to ensure that such measures are proportionate to the circumstances.

Governing Law; Dispute Resolution

These Terms of Use are governed by the laws of Japan, without regard to conflict-of-law principles.

If a dispute arises in connection with the Site, the parties should first attempt to resolve it in good faith. If a resolution cannot be reached, either party may pursue any right or remedy available under applicable law before a court of competent jurisdiction in Japan.

Nothing in these Terms restricts rights or remedies that cannot be waived under applicable consumer law.

Geographic Availability

Alartis administers and operates the Site from Chiba, Japan. The Site may be accessed internationally, but particular products, services, shipping options or Site features may not be available in every country or region.

Users accessing the Site from outside Japan are responsible for complying with laws applicable to them. Alartis may limit the availability of products, services or Site features where necessary for legal, logistical, compliance or commercial reasons.

Miscellaneous

You may not use, export or re-export Content or products obtained through the Site in violation of applicable laws, including applicable Japanese export-control laws and regulations.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

These Terms, together with any policies or transaction-specific terms expressly incorporated into them, constitute the agreement governing your use of the Site. A failure by Alartis to enforce a provision on one occasion does not constitute a waiver of that provision or any other right.

Feedback and Information

Unless otherwise agreed, feedback voluntarily provided to Alartis regarding the Site may be used by Alartis for legitimate business purposes without an obligation of confidentiality.

Information on the Site may be updated without prior notice.
